Terms of Service

Welcome to TooniAI. These Terms of Service ("Terms") govern your use of the TooniAI mobile application (the "App") operated by TooniAI ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

TooniAI is a photo transformation app that uses artificial intelligence (powered by Google's Gemini API) to convert your photos into various art styles, including anime, 3D cartoon, watercolor, oil painting, and more. The App provides 20+ curated art styles. When you submit a photo, it is transmitted through our server-side proxy to Google's Gemini API for processing, and the styled result is returned to your device.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use TooniAI. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these age requirements.

3. Account

TooniAI does not require you to create an account or provide personal information to use the App. An anonymous identifier is automatically created through the App Store and RevenueCat for subscription management purposes. This identifier is tied to your Apple ID and managed by Apple and RevenueCat.

4. Subscriptions and Purchases

Weekly Subscription

• The weekly subscription provides 10 photo transformations per week.
• Your weekly allowance resets every Monday. Unused weekly credits do not roll over.
• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in your device's App Store account settings (Settings > Apple ID > Subscriptions).
• Important: Deleting the App or uninstalling it does not cancel your subscription. You must cancel through your App Store subscription settings to stop recurring charges.

Credit Packs

• Credit packs are one-time, non-recurring purchases.
• Each credit pack provides 10 photo transformation credits.
• Credits from packs never expire.
• Credits from packs are used after your weekly subscription allowance is exhausted.
• Credits are non-transferable and tied to your device.

Pricing

Prices are displayed in your local currency as provided by the App Store. All purchases are processed exclusively by Apple through the App Store. We do not process payments directly.

Refunds

All purchases are made through Apple's App Store. To request a refund, please contact Apple Support or visit reportaproblem.apple.com. We do not have the ability to process refunds directly.

5. Credits System

• Each photo transformation costs 1 credit.
• Weekly subscribers receive 10 credits per week, resetting every Monday.
• If a transformation fails due to a server or API error, the credit used for that transformation is automatically refunded to your balance.
• If a transformation is blocked by content safety filters, the credit is automatically refunded.
• Weekly credits do not roll over to the next week.
• Bonus credits purchased separately do not expire and persist until used.
• If your subscription lapses or is cancelled, any remaining weekly credits are forfeited. Purchased bonus credits are retained.

6. User Content and License Grant

Your Photos

You retain all ownership rights to the photos you upload. We do not claim ownership of your original photos.

License to Process

By submitting a photo for transformation, you grant TooniAI a limited, non-exclusive, royalty-free license to receive, transmit, and temporarily process your photo solely for the purpose of generating the requested art style transformation. This license is limited to operating the service and terminates immediately upon completion of the transformation (when the styled image is returned to your device). We do not retain, store, or use your photos for any other purpose.

Generated Images

You own the styled images generated by the App from your photos. You are free to use, share, and distribute the generated images for personal and commercial purposes, subject to the following:

• You are responsible for ensuring you have the right to use the original photo (including consent from any individuals depicted).
• AI-generated images may have limited or no copyright protection under current law. The legal status of copyright for AI-generated works varies by jurisdiction.
• AI-generated output may inadvertently resemble existing artwork, real people, or copyrighted material. You are responsible for reviewing generated images before sharing or using them commercially.
• You waive any claims against TooniAI arising from the artistic characteristics, appearance, or content of AI-generated images.

Consent for Depicted Individuals

If you submit a photo that contains other people, you represent and warrant that you have obtained the consent of each identifiable individual depicted in the photo to have their image processed and transformed by the App.

7. Acceptable Use

You agree to use TooniAI only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload photos that you do not own or have the right to use.
• Upload photos without the consent of individuals depicted in them.
• Upload photos containing illegal content, including content that sexually exploits minors.
• Attempt to circumvent the credits system, subscription requirements, or any security measures.
• Use the App to generate content that is harmful, abusive, harassing, threatening, defamatory, or otherwise objectionable.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App or its server-side components.
• Use the App in any way that could damage, disable, or impair our services.
• Use automated systems, bots, or scripts to access or interact with the App.

Prohibited Uses of Generated Content

You agree not to use AI-generated images from TooniAI to:

• Create content that exploits or harms minors in any way.
• Generate false or misleading information intended to deceive or harm others.
• Create content used for harassment, bullying, defamation, or discrimination.
• Produce deepfakes or misleading representations of real individuals without their consent.
• Create content for use in fraud, identity theft, or impersonation.

8. Content Filters and AI Limitations

The AI service includes content safety filters that may block certain transformations. You acknowledge and agree that:

• Not all photo and style combinations will produce a result. Content filters may block transformations without detailed explanation.
• If a transformation is blocked, the credit used will be refunded automatically.
• We do not control the specific filtering decisions of the underlying AI service (Google Gemini).
• AI-generated results may vary in quality and may not always meet your expectations.
• The AI may produce unexpected, inaccurate, or imperfect artistic transformations despite our best efforts to curate high-quality style prompts.
• We are not responsible for the artistic characteristics or quality of any specific AI-generated output.

9. Intellectual Property

The App, including its design, features, art style prompts, animations, user interface, and code, is owned by TooniAI and protected by intellectual property laws. The 20+ art style prompts and their descriptions are proprietary to TooniAI. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

10. Copyright Infringement

We respect the intellectual property rights of others. If you believe that content accessible through the App infringes your copyright, please send a notice to our designated agent at support@tooniai.app with the following information:

• A description of the copyrighted work you claim has been infringed.
• A description of where the allegedly infringing material is located.
• Your contact information (name, address, phone number, email).
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
• Your physical or electronic signature.

We will respond to notices of alleged infringement in accordance with applicable law and may remove or disable access to the allegedly infringing material. Repeat infringers may have their access to the App terminated.

11. Third-Party Services

The App relies on third-party services that have their own terms:

• Apple App Store — All purchases are subject to Apple's Licensed Application End User License Agreement.
• Google Gemini API — Photo processing is subject to Google's Terms of Service.
• RevenueCat — Subscription management is subject to RevenueCat's Terms of Service.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will be available at all times without interruption or error.
• The AI-generated results will meet your expectations, preferences, or requirements.
• All art style transformations will be successful (content filters may block certain combinations).
• The App will be free of bugs, viruses, or other harmful components.
• The results obtained from the App will be accurate or reliable.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOONIAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App.
• Any AI-generated content produced by the App.
• Unauthorized access to or alteration of your data.
• Any third-party service failures or interruptions.
• Any content blocked by AI safety filters.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN UNITED STATES DOLLARS ($10 USD).

14. Dispute Resolution

Informal Resolution

Before initiating any formal proceeding, you agree to first contact us at support@tooniai.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.

Class Action Waiver

YOU AND TOONIAI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@tooniai.app within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration.

15. Indemnification

You agree to indemnify, defend, and hold harmless TooniAI and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual property rights or privacy rights; or (d) any content you submit through the App.

16. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App will immediately cease.
• Any unused weekly credits will be forfeited.
• Purchased bonus credits may be forfeited.
• You must manage your subscription cancellation through the App Store to avoid continued billing.

Sections 6, 7, 12, 13, 14, 15, and 17 shall survive any termination of these Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App.

19. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TooniAI regarding the App and supersede all prior agreements, understandings, and communications.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce that or any other provision in the future.

Assignment

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, power failures, internet disruptions, government actions, or third-party service outages (including Google Gemini API or Apple App Store).
